Terms and Conditions

1. INTRODUCTION

1.1. The www.transcoshopping.com website (here forth referred to as "The Site") is a subsidiary owned and operated by Transco International (AUS) Pty Ltd which is an Australian company registered under the company number ABN 79 12 873 829, (here forth referred to as "the Parent Company" or “the Company”). Transco Shopping will hereto be referred to as "Transco Shopping", "We", "Us", and/or "Our" for the following terms and conditions upon which Transco Shopping offers its registered Transco Shopping member (who will be collectively referred to as "Customers") and herein referred to as "User, "Recipient", "You" and/or "Your" permission to use our services.

1.2. The Site includes the website and the contents accessible at the URL link www.transcoshopping.com. "Services" includes all the services offered by us on the Site. "Goods" or "Shipment" or "Package(s)" or "Parcel(s)" means the product, merchandise, or grocery product purchased by the User. "Supplier" means the Retailer, Merchant, or Supermarket who sells the "Goods". The "Virtual Address" is the Transco Shopping warehouse located at 206-208, Discovery Road, Dandenong South, Victoria 3175, Australia, which is also the address given to the User during registration. "Shipment Address" is the designated User address. "Carrier" or "Courier" is considered the company providing door-to-door package delivery services, which will be operated by the Parent Company.

1.3. By using the Site, you agree to be bound by the Terms and Conditions, mentioned below and to utilize the Site per its Terms of Service, Privacy Policy, and other additional terms and conditions mentioned on the Site or from the Parent Company. Before becoming registered, we advise that you carefully peruse the Terms and Conditions mentioned herewith. By registering as a registered member, and using the services, to agree to be bound by these Terms and Conditions, which in turn, forms a legal agreement between you and us, and can only be amended with our consent. Furthermore, it is important to know that your use of the site is also subject to our Privacy Policy.

1.4. You can access your order details, and these Terms and Conditions at any time online by accessing the Site. We, however, do recommend saving a copy of the terms on your computer or device (offline) for future reference.

1.5. The Company reserves the right to change these Terms and Conditions, or impose new conditions on the use of the site periodically, at which point, the revised Terms and Conditions will be shared on the Site. By continuing to use the Site after such a post (declaring any changes and updates), constitutes the acceptance of the Terms and Conditions as modified. Any change will not affect the provision of Services concerning any order that you place or Goods that we receive on your behalf from a Supplier before that change is implemented.

1.6. By accessing the Transco Shopping website and ordering all or in part the services provided by the website (www.transcoshopping.com), you agree to comply with all the provisions of these general conditions of use. Furthermore, you also agree and comply in particular to accept the guarantees and responsibilities described within these Terms and Conditions inclusive of the respective and applicable laws, as well as all regulations, to which constitutes your agreement and compliance with them. Should you not agree to these terms, you would be prohibited from using or accessing the Site nor benefit from the services provided on the Site. 2. REGISTRATION

2.1. Before registration, you must read, agree with and accept all of the Terms and Conditions, and the Privacy Policy, which includes terms of use expressly set out below and those incorporated by reference, before you may register to become a User.

2.2. We highly recommend that, as you read these Terms and Conditions, you also access and read the information included in other pages and websites referred to herein, as they may contain further terms of use that will apply to you as a User.

2.3. Services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our Services are not available to children (persons under the age of 18). You may not use the Site and/or the Services if you do not meet these eligibility criteria.

2.4. By requesting for a Virtual Address, you hereby consent and confirm that the goods purchased will be for personal / non-commercial use.

2.5. Upon successful registration, the User shall be allocated an Australian address, which the User may then provide to Australian online Suppliers as a delivery address ("Virtual Delivery Address") when purchasing Goods.

2.6. Presently, the Transco Shopping site is only available to Sri Lankan based Users, for shipping goods to.

2.7. If the government imposes sanctions for export or import of commodities, you have purchased already and we have your goods in our possession, you have the option to return said Goods to the sender at your own cost, or ship to another Australian address at your own cost or request for us to dispose of it at a cost. Our standard service fee is chargeable upon receiving your Goods.

2.8. Registering with Transco Shopping is free of charge.

3. USE OF SERVICES

3.1. Transco Shopping services are limited to receiving the package on your behalf, packing the received package on your behalf, freight of the package to the destination, clearing the cargo from port and making available the shipment at the bonded warehouse for the user's clearance.

3.2. The user acknowledges and agrees that the services do not include Customs duties or any other Taxes (except where clearly stated). Should customs brokerage be required, the user will be required to request it via the Parent Company, which can provide "Customs Brokerage" or "Customs Clearance" services. Transco Shopping will be solely responsible for the export of its Goods. The user is solely responsible for the payment of any and all Customs Duties, Tariffs, Taxes, destination storage and/or other Charges or Fees of any nature relating to the shipment.

3.3. Transco Shopping operating hours are between 0900 hours and 1600 hours (AEST) from Monday to Friday, hence, we are only able to receive goods during those times. Transco Shopping does not operate during Australia public holidays. You agree to notify the Supplier

when placing an order. We will not be liable to you for any Goods delivered outside business working hours.

3.4. It is the User's responsibility to ensure that any manufacturer's warranty is available and valid in the country that you are based in.

3.5. By placing an order with us, or using our service, you agree that the Goods have been purchased from a Supplier that is authorized to sell and be used in the country you are based.

3.6. It is necessary for you to use the Virtual Address as the address when placing an order directly with the Supplier.

3.7. You authorize us to accept the delivery of Goods at the Virtual Address given on your behalf and appoint us as your freight agent to ship the Goods to the Shipment Address per these Terms and Conditions.

3.8. We will charge you fees for using our services unless stated otherwise. We will also charge you a fee for us to arrange shipment, which is included in the shipping cost. Fees are subject to change from time to time, at our discretion.

3.9. We have the right to open and inspect the Goods we receive without prior notice to the User. You also agree that if we decided to inspect the Goods, we may have to break the seals and open packages on some Goods. We do not accept any liability for any damage caused as a result unless it is directly due to our negligence.

3.10. Notwithstanding any provisions herein, we reserve the right at all times to decline or refuse to accept delivery of any Goods or return of any Goods as we deem appropriate at our absolute discretion and without attributing any reason thereto.

3.11. You will be responsible for all Goods sent to your Virtual Address, even if another person is using your Virtual Address. We will assume that any Goods we receive from a Supplier to your Virtual Address have been ordered by you for us to forward to your Shipment Address. It is important not to pass on details relating to your membership of the Site to anyone that is not authorized to arrange for Goods to be sent to your Virtual Address.

3.12. You must agree to not use your Virtual Address, including declaring it as your residential address, in the application for, renewal of, or replacement of any official documents of financial related materials. This includes but is not limited to using your Virtual Address in setting up a business or company, applying for driving licenses, credit cards, mortgages, loans, or passports. We will not forward official documents to you and will dispose of them and inform to relevant authorities. You must also not provide your Virtual Address as your address to any governmental, regulatory, legal, or financial organization.

3.13. All prices are quoted in Australian Dollars.

3.14. We only accept orders for our Services placed on the site or via email to info@transcoshopping.lk.

3.15. You must not place an order with us or arrange for a supplier to deliver Goods to the Virtual Address at our warehouse, if the total value of the Goods exceeds AUD10,000 or if the weight of the goods in that order exceeds 500kg without contacting us in advance for us to confirm that we are willing to accept those Goods. We may charge you additional fees for accepting it.

3.16. If the weight of a single package is more that 30KG, we have to follow the Australian health and safety requirements and thus palletizing might be required which will incur an additional charge.

3.17. We can store the Goods, which we receive at your Virtual Address for up to 7 days, without charge whilst we await your instructions to ship and your payment for shipping to your Shipment Address. After this time, we will charge a daily storage fee for each package we have stored starting from the 8th day onwards. The fee for each package will accrue daily until the package is shipped or disposed of. The fee we charge for storage is set out on the Site or in an email, which we send you before the charge is incurred.

3.18. You must not arrange for any Goods to be sent to us, or place an order for any Goods with us, where those Goods; may be hazardous or dangerous, are not permitted for international freight, and cannot lawfully be delivered to the jurisdiction in which the Virtual Address is located, and Goods are listed in Section 10 of these Terms and Conditions.

3.19. You cannot arrange your own Carrier or Courier collection of your parcels.

3.20. Payment must be made in full prior to us providing the service. All the services provided to you are non-refundable.

3.21. We reserve the right to refuse to place orders or withholding or dispose of goods or shipments of any transactions involving payment made with unverified or suspicious credit cards. See Section 6.5 regarding Abandoned Goods.

4. FORWARDING SERVICE

4.1. Forwarding is a service provided by us for a registered User. Users can arrange to deliver their Goods order from Suppliers to the Virtual Address and for us to forward it to the Destination Shipment Address designated by the User.

4.2. When we receive your Goods, we will measure and weigh the Goods, and arrange the forwarding of your Goods to your Address via our Parent Company, Transco Cargo. As soon as we receive full payment from you, we will dispatch the Goods to your Shipment Address. Shipping Insurance from the Virtual Address to your Shipment Address is available and it is optional. For more information concerning shipping insurance, please see Section 11.

4.3. If you are ordering directly from the Supplier, the title of the Goods shall remain with the Supplier unit you make full payment for those Goods to the Supplier, at which point title will pass on to you.

4.4. We may choose to perform any of the following activities on User's behalf; Complete any documents, amend product or service codes, and pay any duties or taxes required under applicable laws and regulations (if applicable); and/or act as User's freight agent for the performance of customs clearance and preparation of shipping documents. The item declaration amount will be based on the Supplier invoice of the package. The supplier invoice will be used as supporting documentation.

4.5. All Shipment Addresses once confirmed are final and may not be varied. For payment made via the third-party payment processor, PayPal, Transco Shopping can only ship to the address as provided via PayPal.

4.6. The user agrees to route and diversion of the Shipment, including the possibility that the Shipment may be carried via intermediate transit places.

5. OPTIONAL SERVICES / VALUE ADDED SERVICES

5.1. Such services provided by us for registered Users. Users can request optional services prior to shipping. These services are chargeable.

5.2. The fee for the service is fixed. It is entirely your choice should you choose to proceed. The fee will be provided upon request.

5.3. Optional services can include photographs of goods at the warehouse, goods return, goods disposal, and special requests, which include any other services, not listed.

5.4. Services provided are strictly non-refundable

6. DELIVERIES, UNDELIVERABLES, AND STORAGE

6.1. Transco Shopping does not guarantee delivery of packages that do not comply with the import or export regulations of the country to which they are delivered. It is the responsibility of the User to ensure that the Goods are not restricted or prohibited by the country to which they are delivered.

6.2. If the Recipients refuse delivery or the Goods is deemed to be unacceptable, or it has been undervalued, or the Recipient cannot be reasonably identified or located, or the Recipient does not provide paperwork as requested by Customs or Courier, or the Recipients does not respond or reply to emails requesting for payment of custom duties, freight charges or handlings prior to the uplift or delivery of the Goods, we shall use reasonable efforts to return the Goods to the Supplier at User's cost, failing which the Goods may be released, disposed of or sold by us without incurring any liability, with the proceeds applied against services charges and related administrative costs.

6.3. We will store Goods, which are received at your Virtual Address for up to 7 days without charge, whilst we await your instructions to ship and your payment. After this time, we will charge a daily storage fee for each package we have stored beyond 7 days.

6.4. Notwithstanding anything contained herein, we reserve the right to discard and/or dispose of the Goods delivered to the Virtual Address in any manner we deem fit, with the provision of needing to hand over any illegal items to the Australian authorities for which the User will be liable if your Goods are deemed as Abandoned Goods / illegal.

6.5. You agree that the following can be treated by us as Abandoned Goods:

6.5.1. Goods that been stored for more than 60 days;

6.5.2. You authorize us to disposed of Goods or Abandoned Goods in any manner we choose;

6.5.3. Goods whose owner cannot be identified within 14 days of receipt despite commercially reasonable efforts by us to identify the owner;

6.5.4. Any and all Goods we hold for you if you fail to settle invoices within 7 days for any services we have provided or if you have committed or attempted to commit fraud in connection with the Goods or we are unable to verify you as the purchaser of the Goods;

6.5.5. You will be regarded as the importer of any Goods that we send to you through the Services and it is your responsibility to comply with all laws and regulations of the country in which the Goods are to be delivered. Such goods may be subject to opening and inspection by customs authorities.

7. LOSS, DAMAGE AND DELAY TO SHIPMENT

7.1. We will make every reasonable effort to deliver the Goods according to our regular delivery schedules, which is calculated to happen within 2 working days immediately after full payment of the shipping charges, but these are not guaranteed and are not binding. We are not liable for any damages or losses caused by delays.

7.2. For User who purchased directly from the Supplier, you must arrange the delivery to your Virtual Address. We are not responsible for any Goods in transit from the Supplier to the Virtual Address. When you place an order with a Supplier for delivery to the Virtual Address, it is your responsibility to ensure that the Supplier is given the correct Virtual Address. We shall not be responsible for any incorrectly labelled deliveries of Goods. We cannot be held liable for any mistakes in labelling made by the Supplier

7.3. See Section 9 below for Shipping Insurance Covers from the Virtual Address to your Shipment Address made available. It is your responsibility to take up optional Shipping Insurance to cover your Goods to its full value against loss and damage during transit. Shipping insurance does not cover Goods that are prohibited and restricted as listed in Section 8 below.

7.4. Please note Insurance is calculated at 3% of the order value. There is a minimum cost of $30 to obtain Insurance. This will cover against losses or damages as long as it is notified before removal from the Wattala Transco Warehouse (in the case of a standard shipment) or before the delivery driver leaving your premises at delivery (in the case of Door Delivery). Please note that there will be a mandatory $100 deduction for any claim and we would require proof of purchase when processing Insurance claims.

7.5. In the event of a claim for loss or damage, only one claim can be submitted for one shipment. A claim is up to the maximum value of the Shipping Insurance. The shipping insurance cover includes the cost of goods and shipping costs.

7.6. It is your responsibility to ensure that the items can be shipped to your country. Shipping any items prohibited or restricted by your country import law is at your own risk and we take no responsibility for lost, damage, non-delivery if the items are confiscated by carrier or authority.

8. UNACCEPTABLE AND PROHIBITED GOODS

8.1. It is your responsibility to ensure the Goods are acceptable and not prohibited for us to deliver.

8.2. User agrees that Goods will be deemed unacceptable for Shipment if:

8.2.1. It is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), any applicable government department or other relevant organization.;

8.2.2. No customs declaration is made when required by applicable customs regulations; or

8.2.3. We decide that we cannot transport the Goods safely or legally.

8.3. Goods deemed unacceptable or prohibited for shipment will be returned to the Supplier at User's cost or disposed of. Our decision is final. You will indemnify us and keep us and our employees, sub-contractors and agents indemnified against any and all resulting losses, damaged and/or injuries.

8.4. There are country specifics legislation, which prohibits certain Goods. Please refer to this link for more information - https://www.transcocargo.com.au/customs-shipping/restricted-items

8.5. The items listed below cannot be sent to any countries and the list is not exhaustive. We reserve the right to reject a return to the sender or dispose of prohibited goods without prior notice. Please check with your local import law for further details as to what the restrictions and prohibited items are. It is your responsibility to ensure that the item can be shipped to your country

The following items cannot be sent to any countries;

  • Animals, Animal Products, Animal Skins, Animal Fur, Animal Parts, Live Animals
  • Batteries – loose batteries i.e. laptop batteries, power bank
  • Bullion
  • Cash & Travelers Cheques
  • Clinical and medical waste including biological samples
  • Counterfeit currency, banknotes, and postage stamps
  • Counterfeit goods
  • Credit, Debit, Bank Cards
  • Drugs – including all over-the-counter, prescription or non-prescription and legal drugs as well as illegal drugs/narcotics, legal or illegal highs
  • Environmental Waste
  • Explosives and ammunition
  • Fireworks
  • Flammable liquids, solids or spray in any form
  • Foods that are restricted for import into the destination country
  • Goods, the carriage of which is prohibited by law in the country of origin, transit or destination
  • Illegal goods (these are goods, which are considered illegal in the origin, the transit points and/or the destination)
  • Indecent, obscene or offensive material
  • Infectious Substances
  • Living creatures, living plants or organisms, for example, seeds, yeast
  • Lottery tickets
  • Medicines or any form of medication either prescriptive or non-prescriptive medications
  • Mobile phone SIM card
  • Official documents or financial related materials e.g. Passport, Driving license, Certificate of Incorporation, any financial document or letters, financial security device, and any financial related materials, etc.
  • Perishable food including frozen food
  • Pesticides
  • Poisonous (toxic) and infectious substances
  • Pornography
  • Pressurized container and devices in any form
  • Radioactive materials
  • Real or imitation firearms, parts thereof
  • Tobacco and nicotine related products including e-cigarettes
  • Unidentified substances or items that in our opinion could be any of the other items on this list

8.6. If Prohibited Goods are sent to us, we will deal with them as we see fit which may include disposal (and will charge you for any costs and expenses we incur); and you will indemnify us and keep us and our employees, subcontractors and agents indemnified against any and all resulting losses, damage and/or injuries.

8.7. Restricted Goods may be shipped in certain circumstances with limited liability, which may have limited Shipping Insurance covers. If it is not covered, you are shipping entirely at your own risk, understanding that there is no compensation for loss, damage, or non-delivery. Please inquire with Transco Shopping with regards to conditions if the following items;

  • Articles of exceptional value – i.e. Works of art, Antiques
  • Auto parts
  • Liquids of any variety, including make-up such as mascara and lip gloss, shower gel, lotions and creams
  • Any used or second-hand goods or goods that are deemed as "not working" on arrival
  • "Breakable" plastic items
  • Discs, Tapes, Memory Cards
  • Glass, Mirror, Ceramic, Marble, Pottery, Resin or similar items
  • Any food items
  • Jewellery, Costume Jewellery, Watches & objects constructed of precious metal and/or stones
  • Electrical items and white goods for example but not exclusively: Televisions, Laptops, Computers, Monitors, Mobile Telephones, Computer Chips, CPUs, Circuit Boards

9. CLAIMS AND INSURANCE

9.1. Shipping Insurance is optional service and charged separately, and is considered a separate fee to your shipping/freight charge.

9.2. It is your responsibility to insure the Goods for shipping from the Virtual Address to your Shipment Address. It is always recommended to insure your Goods to its full value. Shipping insurance does not cover Goods that are prohibited and restricted to be imported into your country and as listed in Section 8.

9.3. Please note Insurance is calculated at 3% of the order value. There is a minimum cost of $30 to obtain Insurance. This will only cover against losses or damages of the goods and cargo. Freight cost will not be covered under Insurance.

9.4. It is important to note that the claim should be notified before removal from the Wattala Transco Warehouse (in the case of a standard shipment) or before the delivery driver leaving your premises at delivery (in the case of Door Delivery).

9.5. Please note that there will be a mandatory $100 deductible for every Insurance Claim, and we would require proof of purchase when processing Insurance claims.

9.6. Transco Shopping Shipping Insurance is offered by our Third Party partner to cover both the cost of shipment and damages to outgoing shipments due to loss or damages from external causes during shipment.

9.7. Shipping insurance cover is not available for shipping services without tracking.

9.8. Transco Shopping insured values cannot exceed the actual value of the items. Values on your customs declaration are used to determine the Transco Shopping insured value.

9.9. Prohibited items are excluded from the shipping insurance cover. Items that are prohibited for import into your countries are excluded from the shipping insurance cover. It is your responsibility to ensure that the items can be shipped to your country. A list of prohibited items is listed in Section 8.

9.10. Restricted Goods may be shipped in certain circumstances with limited liability. The items listed in Section 8.7 are restricted goods and have limited Shipping Insurance liability cover.

9.11. In cases of lost or missing parcels, claims must be submitted to our Transco Shopping Support or by email to info@transcoshopping.lk no later than 30 days from the date of shipment.

9.11.1. You will be responsible for submitting any documents requested by our Transco Shopping Support, including but not limited to evidence of value for the affected items.

9.11.2. Once we receive your claim, we will file an official inquiry with the carrier to confirm the loss of the parcel. When we receive such official confirmation of loss, we will issue payment on your claim.

9.11.3. If we cannot confirm the loss with the carrier, we will require additional documentation to complete your claim.

9.11.4. If your parcel is delivered subsequent to our payment of your claim, you will be responsible for repayment to us of the full amount of the claim

9.12. In case of damage to items in a delivered parcel, or loss of individual items within a delivered parcel, claims must be submitted to our Transco Shopping Support within 3 days of delivery.

9.12.1. You will be responsible for providing photographic evidence of damaged items, and any other documentation we may request to substantiate the claim.

9.12.2. In case of loss and/or damage of an individual item within a package(s)/parcel(s) it must be notified to the Transco Warehouse attendee and a claim form needs to be filled prior to removal of goods from the Wattala Transco Warehouse (in Sri Lanka). In the case of a Door Delivery, the delivery agent must be notified and an official complaint must be filed with the delivery carrier prior to them leaving the delivery premises. Evidence of this filing must be provided to us to substantiate your claim along with purchase invoices.

9.13. Our Partnered Third-Party Shipping Insurance covers only damage or loss occurring in transit after a parcel leaves our warehouse. Damage occurring prior to shipment or prior to receipt in our warehouse is not covered.

9.14. Third-Party Partnered Shipping Insurance does NOT cover financial damages arising from any of the following circumstances:

9.14.1. Delay, loss or non-delivery due to the actions of any government authority, including customs and border protection authorities.

9.14.2. Damages arising from a loss of market value, decay, or defects in the product itself.

9.14.3. Incidental or cosmetic damage to product packaging, when the item itself is undamaged.

9.14.4. Claims for reimbursement of postage fees for delivery delays, whatever the cause.

9.14.5. Leakage or damages caused to the package or items by leakage of another product

9.15. The following conditions, if applicable, render the Shipping Insurance void:

9.15.1. Any items in the parcel were shipped in violation of our shipping terms, including prohibited items or items inaccurately declared on customs documents.

9.15.2. Loss, damage, shortage, or non-arrival of the parcel is due to the parcel being insufficiently addressed for delivery.

9.15.3. Loss, damage, shortage, or non-arrival of the parcel is due to the parcel containing items that were not properly disclosed, including but not limited to: lithium-ion batteries, perfume, or any prohibited items.

9.15.4. 3rd party property loss or damage during clearance or delivery

9.15.5. Loss, damage, shortage, or non-arrival due to an act of war or war-like actions.

9.15.6. You initiate a payment dispute or chargeback action against prior payments made to us.

9.15.7. Contents with your shipment contain Any Prohibited Goods, and with limited liability stated as Restricted Goods.

9.16. Claims are paid out into a nominated account in Sri Lanka. Once you accepted the claims and payment has been made, the case is considered close.

10. REFUND, RETURN, AND EXCHANGE

10.1. We are not responsible for any errors by the Supplier in fulfilment of orders or otherwise. The User will have to make arrangements with the Supplier for any returns, refunds, or exchanges of Goods directly in accordance with the Supplier's terms and policies. Transco Shopping will assist to make returns, refunds, and exchange possible.

10.2. We will facilitate the return delivery of Goods ordered from the Supplier while the goods are at the User's Virtual Address or the User's Shipment Address. Applicable return and exchange fees apply.

10.3. All shipping and any duties or taxes associated with the return or exchange will be the sole responsibility of the user.

10.4. We will return and exchange the Goods according to User instructions as to where to deliver the Goods.

10.5. Transco Shopping accepts no responsibility for loss and damage to the return or exchange of these respective Goods.

10.6. You must pay for the exchange fee and all shipping charges before we can return the Goods to the Supplier for exchange.

10.7. An eligible return or exchange will be based upon the individual return/exchange policy of the Suppliers.

10.8. Should you need to return Goods, there will be no storage charges for 7 days. After this period, storage fees apply and the fees are subject to the size of the package.

10.9. It may take up to 3 working days for us to get your package ready for return and we are not responsible for any delay.

11. INDEMNITY AND LIMITATION OF LIABILITY

11.1. The Customer agrees that they will remain liable for and indemnify, defend and hold harmless Transco Shopping and Transco Cargo (Transco Cargo (Pvt) Ltd) and its shareholders, officers, directors, agents, partners, employees, and independent contractors, at all times from the date hereof forward, from and against any and all claims, actions, damages, awards, liabilities, losses (including consequential losses), judgments, costs (including attorneys' fees and court costs) arising because of the execution hereof or the consummation of the transactions contemplated hereby.

11.2. Any negligent action or omission of the Customer or any of the Customer's employees, contractors, agents, or any other person acting under Customer's supervision or control prior to, as of, or following the date hereof.

11.3. The Customer's failure to comply with the terms hereof or any Australian or other jurisdiction's law applicable to the exportation or importation (into the destination country) of such shipments.

12. GENERAL

12.1. We may engage agents and/or sub-contractors to perform all or any part of the Services and such agents and/or sub-contractors (including Couriers) will be entitled to the protection of all the terms in these Terms and Conditions, which exclude or limit our liability.

12.2. Any formal legal notices should be sent to us at the address at the beginning of these Terms and Conditions by post.

12.3. Failure by us to enforce a right does not result in a waiver of such right. You may not assign or transfer your rights under these Terms and Conditions.

12.4. If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and shall remain in force.

12.5. You and we agree that Australian law applies to these Terms and Conditions and that any dispute between us arising out of or in connection with these Terms and Conditions will only be dealt with accordance to the Victorian judicial system in Australia.
